Your Rights and Protections

While the Fair Debt Collection Practices Act exists at the Federal level for the sake of restraining abuses in debt collection the State of Florida took this a step further and enacted the Florida Consumer Collection Practices Act (FCCPA). Amongst other requirements it states that, with some exceptions, a collection entity must register in the State before commencing collection activities. All in all the FCCPA outlines almost 20 prohibited collection activities. Some of these are:

  • Willfully communicate with the debtor or any member of her or his family with such frequency as can be reasonably expected to harass the debtor or their family or to willfully engage in other conduct which can be reasonably expected to abuse or harass the debtor or any member of her or his family
  • Use profane, obscene, vulgar or willfully abusive language in communicating with the debtor or any member of his or her family
  • Use or threaten force or violence
  • Communicate with the debtor between the hours of 9 p.m. and 8 a.m. in the debtor’s time zone without the prior consent of the debtor
